These terms and conditions are served by Wheeler & Oliver Ltd ('The Company' / W&O Ltd) whose registered office is at 21 Queens Road, Gosport, Hampshire, PO12 1LJ, England.  They shall govern your use of our website www.wheelerandoliver.com  and by using our website, you accept these terms and conditions and agree to abide by them.

These Terms and Conditions apply to all goods and services provided by Wheeler & Oliver Ltd. By placing an order with us, you confirm your acceptance of these terms and conditions. Please read them carefully and if there is anything unclear or you are unhappy with please contact us before placing your order.

All leatherworks on this site are handmade by Wheeler & Oliver Ltd and are examples of the company’s work and subject to the following Terms and Conditions. The Company reserves the rights to change these terms and conditions at any time by posting changes online. Your continued use of this site after changes are posted constitutes your acceptance of the revised terms and conditions.

At all times The Company retains the copyright for the pages within this website and the material and information contained in those pages, with all rights reserved.     The pages of this website may not, in whole or in part, be reproduced, copied stored, transmitted or used by any party. You must not alter anything on this website and no material from this site may be used on any other website. No links may be created to this site without our prior written consent. We will not be liable for errors, omissions or for information becoming out of date.

You agree to use this site only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the site by any third party. These terms and conditions shall be governed and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

If these terms and conditions are not accepted in full, the use of this website must be terminated immediately.

Payment

Currency: Pound Sterling

Payments can be made by Bank Transaction, BACS.

Credit / debit card transaction payments over the phone, or Paypal are NOT in use with our company.

Ownership of the goods does not pass to the customer until W&O Ltd has received payment in full. If we repair a customer’s own items, W&O Ltd is entitled to retain such items until payment for the repair is made in full.

Ordering / Communication:

We make every effort to ensure that the order/product descriptions are accurate before the work commences. All orders are discussed and confirmed also in writing by emails to ensure that both parties, Wheeler & Oliver Ltd and the client, are in agreement of all details and aspects of the order.

Any variation(s) or change of mind to the specification of a bespoke order must be communicated to W&O Ltd before work has commenced on the product.

Returns / Exchanges:

We are sorry, but we do not offer exchanges or refunds on bespoke items as all our work is made-to-measure and handmade to clients’ own specifications and requests.

Likewise, we are unable to offer returns or refunds on personalised goods.

Without an online-shop, no goods can be purchased through our website. Therefore we do not offer 14 day cooling-off period for goods/work for the bespoke made-to-order items ordered or purchased from us.

All the specifications of each project and commission are always confirmed in writing by emails before any work commences. That is to ensure that both parties agree all the details, elements and aspects of the order, eliminating any misunderstandings or change of mind after order confirmation.

If in the unlikely instance that there is a problem or fault with and item, then please contact us immediately directly. After the ordered goods/items have been delivered to the client, any misuse or tampering with the goods, or damage caused by negligence/carelessness/mishandling or such will be the responsibility of the client and will not warrant returns / refunds or repairs free of charge.

All our finished products are photographed for security reasons before being packaged and dispatched to the client.

Delivery / Damaged Goods:

We take good care in our packaging and ensure our goods are well protected so they arrive in perfect condition. However, we are not responsible for damage which occurs after the goods have been handed to the postal or courier service. In the unlikely case you receive damaged goods, please let us know immediately. Retain all relevant documentation so that a claim can be made against the carrier’s insurers.

If the parcel is damaged, please note the fact when you sign for it, even before you open the package to examine the contents. Or make sure that you sign for it as “Damaged Package, goods not yet inspected” to warn the carrier that a claim may follow.

We are not responsible for any damage which may occur after the goods have been signed for or while in possession of the client/third party.

We will not accept any responsibility for any wear and tear, accidental damage or failure by you or by any third party to adhere to any written recommendation provided in relation to the goods.

The right to complaint does not cover defects, damages or wear and tear, when resulting directly or indirectly from wrongful use, bad maintenance, violence or unauthorized operations.

If however damage occurs we are happy to try to fix it, but it may be at a cost to the client depending on the extent of it. In this case all postage/courier costs will be the responsibility of the consumer.

We will have no liability to you for any delay in delivering goods you have ordered that is caused by any event or circumstance beyond our reasonable control or for delays caused by postal / courier services.

Leather:

As all authentic leathers and suedes are natural products, please acknowledge and accept that slight differences may occur in regards of the colour, surface look, finish and feel or such.

Website

Our website may contain links to websites owned by others and we are thus not responsible for such sites.

Limitation of Liability

To the extent that we are lawfully able to do so, in no event will Wheeler & Oliver Ltd be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages, not caused by client’s own situations or change of mind regarding their bespoke order, not arising out of access to, or the use/inability to use, this website or any information contained in it or arising out of the services we provide.  This includes loss of profit and the like, whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. This does not affect your statutory rights.

Privacy and Data Protection

Your privacy is taken very seriously, and we will ensure that all your personal information is treated in accordance with the applicable data protection laws in the UK. Your contact details e.g.name; address; telephone number and email address, will be kept secure and any data that you may supply to us will be collected and required to enable us to fulfil your order.

Without an online-shop, no goods can be purchased through our website. We don’t sell any ready-made products on our web site and therefore we do not hold any credit card or other banking details or such of our customers.
